In Australia, divorce and separation are two different legal issues. A married couple that separates can only seek an order for Divorce from the Family Court after they have been separated for at least 12 months. However, you can reach a Financial Settlement or Parenting Orders at any time after separation.

On separation, couples in a De Facto relationship often face similar issues to those experienced by married couples. It is not always straight forward to determine if you are in a De Facto relationship and what should happen to your assets on the breakup of your De Facto relationship. The Family Court of Western Australia has jurisdiction to make Financial Settlement Orders and Parenting Orders following the breakup of a De Facto relationship.
Following separation, the majority of people want to resolve any arising legal issues as quickly as possible in order to move on with their lives. As the court process can be slow and involve significant costs, mediation between the parties – at the right time – can often lead to a timely and cost-effective settlement. When appropriate, we encourage our clients to consider mediation as a viable option for reaching a settlement. If you reach a settlement at mediation, you can file a Consent Order with the Family Court.
A Family Violence Restraining Order (FVRO) is an order typically made by the Magistrates Court. Its purpose is to protect a person who is in a family relationship with another person should that person commit violence towards them and/or their family, threaten them or their property, harass or intimidate them, and they are of the belief that it will continue.
Spousal/Partner Maintenance is separate from child support or child maintenance. Spousal/Partner Maintenance is to assist a person to support themselves financially following separation, where the other party has the financial capacity to provide that assistance. If you are experiencing immediate financial hardship following separation, it is possible to apply to the Family Court for urgent Spousal/Partner Maintenance.
